These terms are effective from September 1st, 2018. They supercede any prior agreement between Specialised Systems and Users relating to the subject matter of these terms.

Definitions
- Agreement: the terms in this document and all related documents.
- Specialised Systems: refers to Specialised Software Systems.
- Content: the intellectual property of Specialised Systems.
- Website: all Content provided by https://specialised.systems.
- User: any person or organisation that visits the Website.
Acceptable use
- Compliance: Users must not violate the laws in their jurisdiction by accessing the Website. They alone are responsible for ensuring their compliance.
- Conduct: While using the Website a User shall never place undue burden on the Website or access it in ways that exceed your authorisation; impersonate a representative of Specialised Systems; or violate the privacy of any third party.
- Privacy: Scraping is the automatic extraction of data from the Website. Data scraped from the Website must be used in accordance with the Specialised Systems' Privacy Statement. Anyone collecting data from the Website must comply with Specialised Systems' Privacy Statement.

- Rights to content: Specialised Systems retain ownership of all intellectual property related to the Website. Its look and feel is copyright © Specialised Systems, all rights reserved. No portion of the Website's source code or visual design elements or concepts may be used without written permission from Specialised Systems.
- Trademarks and Logos: None of Specialised Systems trademarks or logos may be used without written permission from Specialised Systems.
- Survival: All provisions of this Agreement which by their nature should survive termination will survive termination.
Communications
Legal notice to Specialised Systems must be served on Specialised Systems' legal agent in writing.
Disclaimer of warranties
Specialised Systems provide the Website without warranty of any kind. All warranties regarding the Website's merchantability, fitness for a particular services, title, security, accuracy and non-infringement are disclaimed.
Limitation of liability
Specialised Systems shall not be liable to any User or any third party for any loss that result from:
- use or the inability to use the Website;
- modification, price change, suspension or discontinuance of the Website;
- the software or systems that make the Website available;
- unauthorized access or alterations of User data;
- the conduct of any third party on User;
- any other User interactions that occur through the Website; or
- any other matter relating to the Website.
Specialised Systems' liability is limited whether or not it has been informed of the possibility of damages. Specialised Systems are not liable for any failure or delay due to matters beyond our reasonable control.
Changes to these terms
- Specialised Systems may amend these Terms of Service at any time. Ongoing use of the website constitutes agreement to changes to these Terms of Service.
- Specialised Systems reserve the right to discontinue the Website without notice.
Miscellaneous
- Governing Law: This Agreement is governed by the federal laws of Australia and the laws of the state of Queensland. All Users and Specialised Systems submit to the exclusive jurisdiction and venue of the courts located in Brisbane, Queensland.
- Non-Assignability: A User may not assign or delegate any rights or obligations under the Terms of Service or Privacy Statement without the prior written consent of Specialised Systems.
- Survival: If any part of this Agreement is held invalid or unenforceable, that portion of the Agreement will be construed to reflect the parties’ original intent. The remaining portions will remain in full force and effect. Any failure on the part of Specialised Systems to enforce any provision of this agreement will not be considered a waiver of our right to enforce such provision. Our rights under this agreement will survive its termination.
